I have gotten 6 tickets in the pass 1-2 years. I live in Milpitas, California. It's a decent city to live in where the crime rates are very low. Cops are strict on car drivers because Milpitas used to be the haven for racers from all around california. Thanks to fast and the furious! I have received several tickets in milpitas and one of them as actually my fault, so I pleaded guilty and went to traffic school. Another ticket was when the officer accused me of not doing a complete stop when I did. He was coming down the strip and he couldn't have seen me if I did make a complete stop. Being the lazy guy that i am I did not fight that ticket instead I pleaded guilty and the judge gave me 30 hours of community service at Goodwills. The other tickets I got were just minor ones like parking/no seat belts. After I got my sixth ticket I have been really ticked off because I was driving like an old man that day. The one day where I was driving SAFE, I get a ticket.

I learned that I can declare "trail by declaration", where I don't have to show up to court and just write a report defending my traffic ticket. Only 1% of drivers actually contest their traffic tickets. So I wrote a report and I need your help and more evidence of how I can win my trial. I am going to take pictures of the overpass tomorrow. I am definitely not going to back down this time. If you know anything about lidar or tips please post here to help me write a better report. Here's my description of what happened today:

I was driving home from work and I went through an overpass at around 7:30 pm on December 10, 2004. There was the usual traffic, so I drove slower to save on gas because it would be pointless to speed when all three lanes are full and I won’t be getting to my destination any sooner even if I speed. I reached towards the end of the overpass and stopped behind the cross-walk line and when the light turned green the police officer pulled me over. He showed me his Lidar gun which clocked me going 49 on a 35 road. Now for a Lidar gun to be accurate it has to be stationed. Laser cannot be used while the cop car/ motorcycle are rolling because the vibrations would scatter the beam everywhere. The police officer was definitely not stationed because the overpass has no island big enough to safely station a police motorcycle. I was already three-fourth of the way through the overpass when the police officer pulled me over. The officer was on the right lane and tail-gated me as I changed to the left lane. For the officer to be stationed and to catch up to me on time would be unlikely because I was on the right side of the overpass and the island is on the left, the police officer came from right where there is no island at all, just rails so cars don’t flip off the road or something. I lived in Milpitas for more than 10 years and that overpass is known as PB (pigs bank) because at the other end of the overpass there’s usually one cop in a neighborhood waiting for a speeder to pass by. I have driven through the overpass a few hundred times and I know better than to speed over that area. My car is a mid-engine (engine in the back Toyota mr2. Since it’s a 4 cylinder going uphill is a bit of a struggle because the engine is in the back and the weight slows the car down, so I couldn’t have had speed going uphill.
