I am inclined to first remind everyone that the media always gets at least one important fact about every story completely wrong, so there's no way to say what the reality of this particular situation is.
With that said, in a larger sense I do think that it's not unreasonable to charge the "other guy" in a crash like this with Murder 2 or Manslaughter, since it's well within precedent to prosecute people involved in committing a crime for the "incidental" deaths that result. The jury can then look at the particulars of the case and decide whether or not that person really did contribute to the death(s).
